Background
According to the Department of Developmental Services’ SDP home page,
In October of 2013, Governor Edmund G. Brown Jr. signed SB 468 (Emmerson) into law to create the Self Determination Program. SDP provides individuals and their families with more freedom, control, and responsibility in choosing services and supports to help them meet objectives in their Individual Program Plan. During the 3-year implementation period of the SDP, the program only was available to 2,500 individuals. As of July 1, 2021, the SDP is available to all eligible individuals receiving services from a regional center. (“Self-Determination Program (SDP)”)
Pilot Program
California’s pilot program in self determination began in 1998 and served individuals at five regional centers: Kern, Eastern Los Angeles, San Diego, TriCounties, and Redwood Coast.
Slow Roll Out
After SB 468 was passed, the Department of Developmental Services decided to offer access to people served by the regional center through what was originally referred to as the "lottery" but later became known as a slow roll out of SDP. 2500 participants were selected based on demographic criteria. Within this 2500 possible participants were all of the pilot participants. Effort was made to ensure a mixture of people from rural, urban, and suburban areas were eligible for the slow roll out. Additionally, linguistic and ethnic diversity were represented. After the program rolled out, it was opened to the broader regional center community.
Advocacy
Over time, advocates, led by the family and disability-led organization, Disability Voices United, passed SB-468 Developmental services: statewide Self-Determination Program, sponsored by State Senator Emmerson in 2013. Disability Rights California, Disability Voices United, and many advocates worked tirelessly to bring this legislation forward. This community effort is another example of how advocacy is truly a marathon, and not a sprint. This grassroots addition to the Lanterman Act enhanced opportunity for people served by California’s regional center system.
As time progresses, changes are made to statute through trailer bill language. This is one reason on-going professional development and training are so important.
