In thinking about your own sense of ethics, one of the first things to consider is the issue of responsibility. Do you think that all thoughts and actions are result of forces beyond our control or that we have innate freedom of will and our actions are within our own control? This question is key in terms of assessing responsibility for actions including criminal actions and what should be done about those actions.
Persons that think that actions are not within our control have a determinism philosophy. People that hold this philosophy often points to things like poverty or psychological imbalances as causes of crime. If this is true, then ethically the individual criminal should receive help or treatment to correct these conditions.
Persons that think that actions are within our control have an intentionalism philosophy. People that hold this philosophy believe that ethically we should each be held responsible for own actions. If our actions are good, then we should be rewarded and if our actions are criminal, then we should be punished.
So, which philosophy do you follow in making decisions in your life as well as when judging the actions of others? Within the criminal justice system professionals have varying philosophies, however, the system itself is set up on the philosophy of intentionalism. The system is set up to find the guilty individual and hold them responsible for their actions.
