The defense attorney has a number of duties since they need to examine the case from the very beginning. They cannot rely solely on the information provided by a police report are coming from the prosecutor’s office as obviously that information will have a particular slant to it that will not be in support of their client.
Investigate Incident
The defense attorney needs to approach their case from their own perspective which means that they must begin at the beginning. One of the first beginning steps is to investigate the incident beyond what is described in the police report. What are the questions that the police did not ask and are there other witnesses available that the police chose not to use in pushing forward their agenda. There are usually at least two sides each story has and they need to develop the other side.
Interview All
The defense attorney should also interview all parties involved including their client, as well as the victim, and any others that can share information that is relevant or a professional point of view that is in opposition to the prosecutor.
Discuss with Prosecutor
While the prosecutor is the opposition, it is important that a good defense attorney be professional and interacts with the prosecutor when needed. By interacting with the prosecutor, information about the prosecutorial point of view on a case can be obtained which can then help guide strategy with the case. It may also be possible to make plea bargain arrangements which can then be presented to the client for their consideration. The decision whether or not to accept a plea agreement always rests with the defendant though they will likely ask their attorney what they would recommend.
Represent
The attorney should represent the defendant at all procedures both pretrial and during the trial. During the pretrial stages assistant should be provided in terms of filing motion and obtaining subpoenas as well as assisting in deciding on a plea and if there are any possible plea bargain arrangements. If the case goes to court the defense attorney must prepare their side of the case as well as represent the defendant during the actual trial.
Assistance
If the defendant is found guilty, the defense can still provide assistance at sentencing. Not only should they be present at the sentencing to offer moral support to their client but prior to sentencing they can also suggest alternative sentencing or lesser sentencing options to the judge compared to what the prosecutor might have recommended to the judge. Even after the sentencing, the defense attorney can provide assistance to their client by determining if there is a basis for appeal of the case if they think the defendant’s rights were violated or there were significant judicial errors.
