Whether the defendant is on some form of pretrial release or remains in custody, one of the first pretrial steps is that of arraignment. The arraignment is often referred to as the initial hearing or the preliminary hearing or pre-lims for short. This particular hearing is an open proceeding conducted before a judge.
Both the prosecution and defense will attend the arraignment the accused are advised of their right and rules of evidence apply. It is possible so unlikely that witnesses may be confronted. If the accused cannot afford an attorney assigned counsel will be provided for them. Once the accused have counsel, if they wish it, they will be asked how they plead to the charges against them which are read out loud to the court. The defendant will make their plea and the judge will decide on whether to bind the case over for trial. The possible pleas are: guilty, not guilty, nolo contendere, and not guilty by reason of insanity.
