If the defendant is accused of a felony and or is a notable individual the preliminary step of a grand jury may be used even before the initial hearing. The idea of a grand jury is derived from the Magna Carta. The idea is that a group of citizens representing the people of the area will determine if probable cause exists for the accused to be bound over for trial.
The grand jury session is controlled by the prosecutor and is a closed and secret deliberation not in open court. Because this hearing is held by the prosecutor and neither the accused nor their attorney are allowed to attend it is considered a one-sided procedure. Initially, this step was meant to serve as a checks and balance of government powers over accused citizens.
Many individuals question if this is a necessary step in modern times as it is costly and creates delays for the court system. Additionally, many individuals question if a random group of average citizens would tell the prosecutor that they do not have a case when they are trying to convince the citizens that they do. This grand jury does not determine guilt or innocence they only determine if there is probable cause for the prosecutor to continue prosecuting the case.
