With pretrial release of any form, at issue are the sometimes conflicting rights of the accused to be free before trial, and the need of the state to protect citizens from the accused prior to trial. One method of trying to ensure that the accused will cooperate and not harm citizens is the use of money or other form of security which is offered as a guarantee by the accused. This offering of money as a guarantee that the accused will return for all trial procedures if released from custody now, is often called bail.
Some people mistakenly assume that citizens are guaranteed the right to bail. While bail is mentioned in the eighth amendment to the constitution it does not guarantee the right to bail but rather it states that if bail is granted it should not be excessive. So basically, if the crime is small the amount of bail should be small but if the crime is serious, bail could be set high or denied completely. Bail is not a punishment because at this phase of the court steps the individual is still presumed to be innocent.
Problems with Bail
While bail is a creative way to attempt to ensure compliance, it is not without problems. One problem is that not all individuals can afford bail even when it is set relatively low. Another problem is that some individuals will run away or abscond when released and it is often hard to predict which individuals this will be. Worse yet is when individuals continue to commit more offenses while they are out on release.
Bail bonds persons make their living off the plight of the poor individuals caught up in the criminal justice system. If a poor individual cannot make their full bail payment they can make arrangements with bail bonds persons who will make the payment on their behalf. The problem in that the person that can afford the bail payment will have their bail returned to them at the end of court proceedings. On the other hand, those who paid the bail bonds person will not have their money returned even if they are found innocent in court.
Because of the expense of bail many individuals both guilty and innocent await their trial by remaining in jail. This means that potentially innocent individuals are being punished before their chance to prove their innocence and given that some jails are very dangerous, these dangerous conditions may be imposed on innocent people as well.
Bail Reform
To counteract some of the problems with bail, some jurisdictions are looking at family ties and work history in order to expand the use of ROR. In other jurisdictions they are developing bail guidelines which offer suggested rates of bail based on the lifestyle, in terms of prior criminal history, and the offense of the accused in order to limit judicial discretion and overly high or low bail amounts.
