Much of the history of our institutions can easily be traced back to early English history. In the beginning of English institutions the conditions were typically very brutal and quite unsanitary. They did not separate inmates by age, gender, or even type of offense and so many individuals did not survive the experience. In English history, they did not feel that the government should look out for those in institutions but rather they felt that the people in the institutions owed the government.
Fee System
The Shire reeves that we spoke about in an earlier chapter, often ran the early institutions and they based it on a fee system. There was a fee for admission, you had to pay for any food you wanted to eat, you would have to pay if you needed medicine, and there was even a fee for discharge to have your shackles removed even if you had been found innocent in court. For those who had money this was still a terrible ordeal but those without money often died of starvation, illness, or attacks by other inmates or even the guards.
Penitentiary Act
By the end of the 18th century in England they passed the Penitentiary Act, which established an orderly penal system, eliminated the fee system, implemented periodic inspections, and stated that there needed to be greater consideration for inmates. This is greater consideration for inmates was about the level of consideration you would give livestock still that was an improvement compared to how the human inmates were being treated before.
