- describe the behaviors included in the NAR Code of Ethics.
- examine ethical dilemmas, their potential consequences, and possible resolutions.
- describe at least three common areas of conflict in real estate transactions and explain three ways to approach conflict resolution.
- identify important elements of real estate law, including fiduciary duty, and common violations thereof.
- discuss and give examples of professionalism and service standards.
Introduction
Are law and ethics the same? Sometimes what is unethical is not illegal, although in some cases we might think that something unethical should be illegal. The REALTOR® Code of Ethics sets out principles and behaviors to guide the actions of real estate professionals. Some of its standards are higher or more exacting than legal standards. A violation of this Code can result in serious penalties from the local Association of REALTORS®, usually from their committee on Professional Standards.
Module 10 introduces you to the concept of ethics and helps you distinguish between illegal behaviors and unethical behaviors. Within the context of the REALTOR® Code of Ethics, the module will explore ethical dilemmas, assess potential consequences of various options, and evaluate possible resolutions for them. Later, the module will address professionalism and service standards.
